- Customer can access its Personal Space by logging in to the Website using its connection ID and password.
- Customer agrees to use the Services itself personally and agree not to allow any third party to use them on their behalf, unless accepting full responsibility for the consequences.
- Customer is also responsible for keeping its connection ID and password confidential, as any access to the Website with this ID and password are deemed to be made by the Customer. Customers must contact ITSDB CENTER LLC immediately through one of our communication channels, if it notices that their Account has been used without its knowledge. Customer acknowledges ITSDB CENTER LLC right to take all measures it deems appropriate in a case such as this.

The Consumer has access to statistics on the use of the Services on its Personal Space in a form and according to the functionalities and technical means that ITSDB CENTER LLC deems most appropriate.
6.3 Technical assistance

6.4 Other Services
ITSDB CENTER LLC reserves the right to propose any other Service that it deems useful, in a format and according to the technical means that it deems the most appropriate for providing the said Service.
6.5 Cancellation of subscription or service
All you have to do is submit a request for termination of service, before 24 hours after your payment, then we will proceed with your request to follow up on your request within 48 hours.
7. Financial Conditions
7.1 Price of the Services & Products

◦ Our «Services» pricing depends according to your demands.
7.2 Terms of payment
ITSDB CENTER LLC shall send an invoice to the Customer, by any means deemed useful, on the due date for payment of the price.
The Customer shall make payment by any means deemed useful by ITSDB CENTER LLC and in particular by bank transfer to the bank details, or by cryptocurrency indicated on each invoice.
The Customer guarantees ITSDB CENTER LLC that it has the necessary authorisations to proceed with the payment of the price.
7.3 Payment delays and incidents
Customer is hereby informed and expressly agrees that any payment delay of all or part of any payable amount due to ITSDB CENTER LLC at its due term shall automatically entail, and from the day following the payment date indicated on the invoice:
◦ (i) The forfeiture of the term of all amounts payable by the Customer and their immediate playability, regardless of the terms of payment that had been provided;
◦ (ii) The immediate suspension of the Services and access to the Website until full payment of all amounts due;
In case of cancellation of your service, you will receive your payment, the same channel that you have use; with the exception, if your payment was made by Bitcoin, your money will be returned to you through other channels according to the dollar rate at the time.
8. Agreement in relation to proof
Customers expressly acknowledge and accept that:
◦ (i) Data collected on ITSDB CENTER LLC Website and its computer equipment attest to the reality of the transactions performed in the context of this Agreement,
◦ (ii) This data is the main means of acceptable proof between the parties.
9. Obligations for Customers
Customers agree, in their use of the Services, to respect and abide by all laws and regulations in force and not to violate public order or infringe the rights of any third party.
9.1 It is solely responsible for its use of the Website and the Services.
9.2 Customers agree to provide ITSDB CENTER LLC with all information necessary for the proper performance of the Services. More generally, Customers agree to actively cooperate with ITSDB CENTER LLC with a view to ensuring the proper performance of this Agreement.
9.3 Customers are solely responsible for the documents, elements, data, information and any content that it provides to ITSDB CENTER LLC in the context of the use of the Services. Customers guarantee to ITSDB CENTER LLC that it is authorized to provide it with these elements and that it has all the rights and authorizations necessary for their use in the context of the Services.
9.4 Customers acknowledge to be aware of the Website and its characteristics.
9.5 Customers undertake to make strictly personal use of the Services. Consequently, it undertakes to refrain from assigning, conceding or transferring all or part of its rights or obligations hereunder to a third party, in any manner whatsoever.
9.6 Customers are solely responsible for the contents of whatever nature (editorial, graphic, audio, audiovisual or otherwise) that they display on the Website (hereinafter referred to as the 'Content') and any consequences.
9.7 Customer accept that the Content published on the Website is made public by default and is likely to be seen by other Customers of the Website.
9.8 Customers therefore agree to refrain from publishing, in particular, but not limited to:
9.9 • Counterfeit Content,
9.10 • Content that is detrimental to the image of any third party,
9.11 • Content that is false, misleading or proposing or promoting unlawful, fraudulent or misleading activities,
9.12 • And, more generally, any Content that is likely to infringe on the rights of others or cause harm to others in any manner or form.
10. Liability and guarantee of ITSDB CENTER LLC
10.1 ITSDB CENTER LLC agrees to provide the Services with diligence and in compliance with trade practice, specifying that it has an obligation to provide due care.
10.2 ITSDB CENTER LLC undertakes to make its best efforts to comply with the timetable indicated to the Customers in the Quotation. However, the Customers is expressly informed and accepts that these deadlines are provided for information purposes only, and that ITSDB CENTER LLC shall not be held liable in the absence of any fault on its part for failure to comply with them. The Customers is furthermore informed and accepts that any delay attributable to it shall postpone the agreed delivery dates by the same amount.
10.3 ITSDB CENTER LLC undertakes to carry out regular checks in order to verify the operation and accessibility of the Website. In this respect, ITSDB CENTER LLC reserves the right to temporarily interrupt access to the Website for maintenance reasons.
10.4 Likewise, ITSDB CENTER LLC shall not be held liable for momentary difficulties or impossibilities in accessing its Website due to circumstances beyond its control, major force, or due to disruptions in the telecommunications networks, as the Customers are informed of the complexity of the global networks and the influx of Internet Customers at certain times of the day.
11. Confidentiality
The party receiving Confidential Information undertakes not to disclose it without the prior consent of the other party. It may only transmit them to employees, collaborators, trainees or consultants if they are bound by the same obligation of confidentiality as provided for herein. This obligation does not extend to documents, elements, data and information:
(i) of which the receiving party was already aware;
(ii) which were already public at the time of their communication or which would become public without breach of this Agreement;
(iii) which would have been lawfully received from a third party;
(v) the disclosure of which is required by judicial authorities,
Each party undertakes to keep strictly confidential the documents, elements, data and information of the other party which it may receive which are expressly identified by the other party as confidential. As far as ITSDB CENTER LLC is concerned, the parties expressly agree that this obligation of confidentiality shall cover the personal data that it will be required to process for the Customer within the framework of the Services.
All of this information is hereinafter referred to as 'Confidential Information'.
12. Personal data
ITSDB CENTER LLC practises a policy of protection of personal data, the characteristics of which are detailed in the document "Privacy Policy", which Customers are expressly invited to read.
13. Customer references
The Customer expressly authorizes ITSDB CENTER LLC to name and use as appropriate a reproduction of its trademark or logo as a customer reference, in particular during events, in its commercial documents, on its Website, in any form whatsoever during the term of the Agreement.
14. Major Force
Neither Party may be held liable for a failure to perform its contractual obligations if this failure is due to an event beyond the Parties' control and constitutes major force.
The prevented party shall inform the other party as soon as possible, indicating the nature of the case of major force. The parties shall come together to determine together the most appropriate means to alleviate, if possible, the consequences of the event(s) constituting major force.
If the case of force majeure lasts more than 3 (three) months, each party may terminate the Contract, as of right, without legal formality, without formal notice and without the right to compensation of any kind, by sending a registered letter with acknowledgment of receipt with immediate effect.
If, as a result of a case of major force, the affected party is prevented from fulfilling only part of its contractual obligations, it shall remain liable for the fulfilment of the obligations not affected by the case of major force as well as its payment obligations.
As soon as the case of major force ceases, the prevented party must immediately inform the other party and resume performance of the affected obligations within a reasonable period of time.
15. Amendments
ITSDB CENTER LLC reserves the right to amend these General Terms and Conditions at any time.
Customers shall be informed of these amendments through any pertinent channel.
Any Customer who does not agree with the amended General Terms and Conditions must unsubscribe from the Services according to the provisions set out in Article “Term of the Services, unsubscription”.
Customers who continue to use the Services after the entry into force of the amended terms and conditions shall be deemed to have accepted these amendments.
